Our Shrine was established and recognized on September 4, 2012 by the Philippines Securities and Exchange Commission through the the power of the Corporation code of the Philippines or Batas Pambansa 68 that was approved on May 1, 1980. In this code, On Title 13 Chapter 2 Section 109 states that:
Religious corporations may be incorporated by one or more persons. Such corporations may be classified into corporation sole and religious societies.
Title XIII Chapter 2 Section 109 Corporation code of the Philippines
According to this law, a Corporation is an artificial being created by operation of law, having the right of succession and the powers, attributes and properties expressly authorized by law or incident to its existence.
Title 1 Section 2 Corporation Code of the Philippines
And in our Certificate of Incorporation it states that Luntiang Aghama Natural Divine Arts Shrine of Healing Inc. has been granted Juridical Personality, and in our Article of Incorporation on section 3 states that: Rolando Gomez Comon, is in charge of the administration of the temporalities and the management of the affairs, estate and properties of Luntiang Aghama Natural Divine Arts Shrine of Healing Inc. And that is what we do when we register our Shrine to the Philippine Securities and Exchange Commission.
On the Last week of June 2020, our Freedom of Religion has been tested as I was advised to separate my personal finances to the Shrine expenses. So what I did is to open the Shrine it’s own Bank Savings account for the safekeeping of the Financial donations of our members and general public.
At first I asked East West Bank in Tungkong Mangga, City of San Jose Del Monte, Bulacan if i could open a savings account for a Religious Corporation Sole. But unfortunately they deny my request as they said that they have never have experience that a Religious Corporation Sole to open a savings account. So i move to BPI also in Tungkong Mangga.
The Bank Manager is in hesitation to process my request and admit that this will be their first time to process in opening a bank savings account for a Religious Corporation Sole. They gave me requirements that in order to open a Bank Account, I need to produce a Board Resolution signed by the Board of Directors. But I insisted that we are a Religious Corporation Sole, which means according to the Corporation Code of the Philippines on Title 13 Chapter 2 Section 110 that:
For the purpose of administering and managing, as trustee, the affairs, property and temporalities of any religious denomination, sect or church, a corporation sole may be formed by Chief Archbishop, Bishop, Priest, Minister, Rabbi or other presiding elder of such religious denomination, Sect, or Church.
And according to Wikipedia.org; a Corporation Sole is a legal entity consisting of a single (sole which means one not two, three or 5) incorporated office occupied by a single (sole) natural person.
I refused the demand of the Bank Manager to me to produce a document or Board Resolution Signed by the Board of Trustees as I insist that I am the SOLE TRUSTEE that makes me the Corporation Sole in accordance to the Law of the Land. Through this month long of struggle with prayer and ritual, my bank savings account application for the Shrine was approved as i insist my power and authority as a Religious Corporation Sole.
The Requirements i provide in opening a Bank Account is the Certificate of Incorporation, Articles of Incorporation, Affidavit of Declaration as Chief Priest, and Affidavit of Authority as Corporation Sole
